Information usage

Phi Network Systems may use Personally Identifiable Information including but not limited to your name, e-mail address, street address, telephone number, subject to the terms of this privacy policy. We will never sell, barter, disclose, or rent your email address to any unauthorized third party.

Gathering Information

How we collect and store information depends on the page you are visiting and/or the activities which are required to service and maintain your orders, products and the services provided. For example, you may be asked to provide information when you register for access to certain portions of our site or request certain features when you make a purchase. Like most Web sites, Phi Network Systems also collects information automatically and through the use of electronic tools that may be transparent to our visitors. For example, we may log the name of your Internet Service Provider or use cookie technology to recognize you and hold information from your visit. Among other things, the cookie may store your user name and password, sparing you from having to re-enter that information each time you visit any given page. As we adopt additional technology, we may also gather information through other means. In certain cases, you can choose not to provide us with information, for example by setting your browser to refuse to accept cookies, but if you do you may be unable to access certain portions of the site or may be asked to re-enter your user name and password, and we may not be able provide the site's required functionality according to your expectations.

Phi Network Systems does not attempt to gather or retain any information personally idenitifiable or otherwise which is not essential to providing you the service or function which you are requesting. Any cookies that our web pages utilise are simply strictly required for correct functioning of those pages.

What do we do with the information we collect

We respect your privacy and do not share your information with anyone without your explicit informed consent or as required by legal orders. Any information gathered is retained either for

Information (aggregated or otherwise) provided during an order or as a result of visiting a webpage is collected and retained purely in order to provide the service of said request. We will not and do not requestor harvest any information that is not totally essential to providing the service requested of us (including but not limited to providing you with a proper VAT invoice).

Personally Identifiable Information logged and/or collected by Phi Network Systems may also be used for other purposes, including but not limited to site administration, troubleshooting, processing of e-commerce transactions and other communications with you.

Certain third parties (including but not limted to your ISP ) who provide technical support for the operation of our site (our Web hosting service for example) may access such information Such access is beyond our control and we direct you to the privacy policy of those 3rd parties (intermediary or otherwise).

In addition some of our suppliers (including but not limited to e.g. ICANN, Nominet) require information from us in order for us to provide the service you have requested. In such cases we refer you to the privacy policies of those suppliers.

We will use your information only as permitted by you and by law. In addition, from time to time as we continue to develop our business, we may sell, buy, merge or partner with other companies or businesses. In such transactions, user information may be among the transferred assets. We may also disclose your information in response to a court order, at other times when we believe we are reasonably required to do so by law, in connection with the collection of amounts you may owe to us, and/or to law enforcement authorities whenever we deem it appropriate or necessary. Please note we may not provide you with notice prior to disclosure in such cases.

Affiliated sites, linked sites and advertisements

NB : This section is as much for advertisers, bot operators, harvesters and search engines as it is for clients and visitors

Phi Network Systems expects partners, advertisers and affiliates to respect the privacy of our users. Be aware, however, that third parties, including partners, advertisers, affiliates and other content providers accessible through (or using/visiting) our site, may have their own privacy and data collection policies and practices. Also, through Phi Network Systems you may be introduced to, or be able to access, information, Web sites, features, offered by other parties. Phi Network Systems is not (and cannot be) responsible for the actions or policies of such third parties. You should check the applicable privacy policies of those third parties when providing information on a feature or page operated by a third party. As already stated we will not divulge or reveal any information to any parties unless authorised by you or as required in order to provide you the service you have requested. We reserve the right to deny any service without reason. We will not however deny service as a result of you refusing to (or failing to consent to) provide information which is not essential to providing a service. (We can say that because it is policy to only request and retain information essential to providing a service). Note that should a 3rd party supplier request such unnecessary information we would decline to provide it unless you have provided informed consent to do so. In such an event we direct you to the 3rd party that is refusing to provide the service. Phi Network Systems cannot be held responsible in such circumstances. Furthermore, whilst we will always endevour to support or clients in all matters, if we deem that it is not in our best interests or the interests of our clients to hold a 3rd party accountable (with or without reason), then we cannot and will not be held counter-accountable. Again, we direct you to the privacy and T&C's of the concerned 3rd party.

Features available on our site may offer services operated by third parties and may use cookies or other technology to gather information. Phi Network Systems does not control the use of this technology by third parties or the resulting information, and is not responsible for any actions or policies of such third parties.

You should also be aware that if you voluntarily disclose Personally Identifiable Information on message boards or in chat areas, that information can be viewed publicly and can be collected and used by third parties without our knowledge and may result in unsolicited messages from other individuals or third parties. Such activities are beyond the control of Phi Network Systems and this policy. Note also that use of third party services such as these may in fact cause any account you have with Phi Network Systems to be terminated as per our General Terms and Conditions. Many of our company SOP's and security policies are confidential as are all our customer held data. Revealing any of these (in part or in whole), your communications with ourslves (in part or in whole) or any information relating to another client could (and most likely would) constitute an unauthorised data leak.

You are futhermore advised to enable any and all browser security features you deem necessary in order to protect your information and privacy.

Additionally when a 3rd party operator or service provider (search engine, media site) presents any information related or seemingly related to Phi Network Systems, it's suppliers or clients, it must be appreciated that Phi Network Systems is not responsible for that 3rd parties actions. Furthermore Phi Network Systems can neither attest nor comment on the accuracy, validity or source of said presentations as we are in no way involved with the operation or moderation of those services.

Children

Phi Network Systems does not knowingly collect or solicit Personally Identifiable Information from or about children under 13. If we discover we have received any information from a child under 13 in violation of this policy (or is as permitted by law), we will delete that information immediately. Changes to this Policy

Phi Network Systems reserves the right to change this policy at any time. Please check this page periodically for changes. Your continued use of our site following the posting of changes to these terms will mean you accept those changes. Information collected prior to the time any change is posted will be used according to the rules and laws that applied at the time the information was collected.

Governing law

This policy and the use of this Site are governed by U.K. law. If a dispute arises under this Policy we agree to first try to resolve it with the help of a mutually agreed-upon mediator in the following location: Northern Ireland. Any costs and fees other than attorney fees associated with the mediation will be shared equally by each of us.

If it proves impossible to arrive at a mutually satisfactory solution through mediation, we agree to submit the dispute to binding arbitration at the following location: Northern Ireland. Judgment upon the award rendered by the arbitration may be entered in any court with jurisdiction to do so.

Phi Network Systems is controlled, operated and administered entirely within the UK. This statement and the policies outlined herein are not intended to and do not create any contractual or other legal rights in or on behalf of any party.

The application of the United Nations Convention on Contracts for the International Sale of Goods, as amended, is expressly excluded.

Malicious prosecution

Phi Network Systems will hold accountable and liable any prosecution pursued spitefully and/or without reasonable or probable cause. The prosecuting party will be held liable for any and all legal costs and company damages incurred under such actions. Your attention is now directed to our Terms and Conditions.
